These Terms of Use (the "Terms") govern your access to and use of the Visage AI Bot service (the "Service") provided by EvoScale Company Limited ("we", "us", "our").

1. Service description

Visage AI Bot is a digital service that creates AI-generated images based on photos and text prompts provided by you. The Service:

• Receives your selfies and other photos to build a personal AI avatar of your face.
• Generates digital images of you in different visual styles and settings.
• Operates only online. We do not provide any physical products.

2. Acceptance of Terms

By accessing or using the Service, including making a payment or sending photos to the bot, you confirm that you:

• Have read, understood and agree to these Terms;
• Are at least 18 years old or have legal capacity to enter into a contract;
• Use the Service in compliance with applicable laws in your jurisdiction.

If you do not agree to these Terms, you must not use the Service.

3. Eligibility and user responsibilities

You agree to:

• Provide accurate information when using the Service;
• Use only photos that you have the right to use (e.g. your own photos);
• Not upload content that is illegal, hateful, exploitative or violates the rights of others;
• Not attempt to misuse, hack, reverse engineer or disrupt the Service.

4. Digital content only

All outputs from Visage AI Bot are digital images and online services only. There is no shipping, delivery of physical goods, or hardware involved. Your purchase gives you access to:

• AI-generated images (digital files);
• Credits to generate more images;
• Access to the bot and your AI avatar while your subscription and/or credits are active.

5. Payments and pricing

Payments are processed securely through external payment system. We do not store your full card details on our servers. Prices are shown in US dollars (USD) unless clearly stated otherwise.

The current pricing and packages are displayed on our main website and on the payment processor's checkout page before you confirm payment.

5.1 One-time packages

You can purchase fixed packages of image generation credits (e.g., 10 / 100 / 500 / 1000 photos). These are one-time payments and are not recurring by default.

5.2 Subscription for storage

To keep your AI avatar and related data available, we may offer an optional recurring storage subscription. Details (price, billing cycle) are clearly shown on the payment processor's checkout page and in our Subscription & Billing Policy.

6. No unlawful or harmful use

You agree not to use the Service to:

• Create content that is illegal, abusive, harassing, hateful or discriminatory;
• Impersonate another person without their explicit consent;
• Generate content that sexually exploits minors or promotes violence;
• Violate intellectual property, privacy, or other rights of any person.

7. Intellectual property

All software, models, algorithms, and branding related to Visage AI Bot are owned or licensed by EvoScale Company Limited. You receive a limited, non-exclusive license to use the Service and download generated images for personal and commercial use, unless otherwise restricted by law or specific agreement.

You are responsible for ensuring that your use of generated images complies with laws and platform rules (social media, marketplaces, etc.).

8. Data protection and privacy

We collect and process your personal data, including photos, in accordance with our Privacy Policy. By using the Service, you agree that we may process your data as described in that policy.

9. Refunds

Our refund conditions are described in detail in our Refund Policy. In summary, we may provide a refund in cases of duplicate payments, technical failures, or incorrect charges, subject to the conditions and timelines specified there.

10. Suspension and termination

We may suspend or terminate your access to the Service without prior notice if we reasonably believe that you:

• Violate these Terms;
• Use the Service in a fraudulent, abusive or harmful way;
• Engage in illegal activities related to the Service.

11. Disclaimer of warranties

The Service is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, EvoScale Company Limited will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising out of your use of the Service.

13. Changes to the Terms

We may update these Terms from time to time. The latest version will always be available on this page with the "Last updated" date. Your continued use of the Service after changes are posted means you accept the updated Terms.
